Shackled and Handcuffed Witness Refuses To Testify For Second Time

For the second time this week, Devin Morningstar was called by the Crown as a witness in 22-year old Marissa Shephard’s trial for first degree murder and arson.

Morningstar, shackled and handcuffed, was escorted by a Sheriff through the prisoner’s box, past Shephard towards the witness stand.

As with his court appearance on Wednesday, Morningstar refused to be sworn in to deliver his testimony.

Justice Zoël Dionne asked him if he was willing to answer questions without an oath or solemn affirmation, and Morningstar refused that option too, confirming he would not be answering any questions.

At this time, it remains unclear what the Crown will do with Morningstar and his testimony.
