A dispute involving roughly 4,100 unionized nursing home workers in New Brunswick will return to court next month.
The New Brunswick Court of Appeal will hear the case, which could impact the workers’ ability to strike.
In July, the Court of Queen’s Bench upheld a labour board ruling which found the Essential Services in Nursing Homes Act is unconstitutional.
Justice Tracey DeWare also gave the province until January to amend the legislation.
But the province later filed an appeal of the ruling, which will be heard on Oct. 29.
The province initially asked for a judicial review of the act in March after the workers voted in favour of a strike.
