An micro-cannabis company has filed a judicial review over a provincial decision which denied it from building an indoor growing operation.
Anchor Cannabis co-owner Gina Brown is claiming a decision earlier this year to deny rezoning of their Upper Coverdale business was not fair.
“Hopefully they (the court) will be able to clear it up and did the province follow the law? I’m making the case that no, they didn’t follow the law to do what they did.”
The company located on Route 112 was seeking to construct a 2,100 square foot building for indoor cultivation.
In June, then Environment Minister Jeff Carr outlined numerous reasons why the rezoning from agricultural to commercial-industrial was denied including available water sources and community concerns.
Brown is also appealing a provincial decision to not allow cannabis production in an industrial zone.
“It’s been very difficult because you have the government telling the province that cannabis being grown in a building is ‘highly problematic’ and it’s really hard to make an argument against what your government is telling people.”
The judicial review is scheduled to be heard in Moncton Provincial Court on November 13.
