Shephard Trial Delayed At Least Two Days To Allow For ‘Voir Dire’

There will be no public reporting from the trial of 22-year old Marissa Shephard today or tomorrow.

Justice Zoël Dionne told the jury Monday afternoon there is a crucial issue of admissibility of evidence that needs to be addressed in a voir dire.

He says it will likely take up this week and part of the next.

Judge Dionne described a voir dire as a trial within a trial, where the presiding judge rules on whether specific evidence can be admitted, after listening to arguments from both the Crown and Defence.

The jury is never present for this process, and no details of what happens in a voir dire can be made public until the jurors begin deliberations.

Judge Dionne told the jury to return Thursday morning, adding they would be able to more accurately predict when the trial proper will continue.
